GenFlix terms & conditions.

Effective date: 2 May 2026 • Jurisdiction: Queensland, Australia

These Terms and Conditions ("Terms") constitute a binding legal agreement between you ("User", "Creator", "Viewer", "Festival Organiser", "Judge", or "Agency") and GENFLIX PTY LTD (ACN 694 435 571) ("GenFlix", "we", "us", or "our").

By accessing the GenFlix Cinema, Creator Studio, Agency Studio, Festival Studio, public festival pages, or any associated services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, you must not use the Service.

WARNING FOR INTERNATIONAL USERS: These Terms may include dispute resolution provisions and waivers of class action rights where permitted by applicable law.

1. Eligibility & account security

You must be at least 18 years old to create a Creator Studio, Agency Studio, or Festival Studio account, or to upload content.

Viewers under 18 may use the GenFlix Cinema only with the supervision of a parent or guardian.

You represent that you are not located in a country subject to Australian or United States sanctions or trade restrictions.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

GenFlix is not liable for losses resulting from unauthorised access to your account.

GenFlix reserves the right to suspend, restrict, or terminate accounts suspected of:

  • fraudulent activity
  • automated manipulation or bot activity
  • platform abuse
  • violations of these Terms

1A. Festival Studio, organisers & judges

Festival Studio lets approved or invited organisers create and manage festival programmes, categories, submission windows, programme terms, judging workflows, selections, and related communications.

Festival Organisers are solely responsible for their programmes, including:

  • eligibility rules, category descriptions, deadlines, judging criteria, and selection procedures
  • accuracy of public programme pages, organiser names, logos, dates, locations, and prize information
  • obtaining any permits, rights, consents, clearances, tax advice, and insurance required for the programme
  • honouring any prizes, benefits, screenings, awards, laurels, or representations they publish
  • appointing, managing, and removing judges, co-organisers, staff, and other authorised users
  • complying with consumer law, privacy law, anti-discrimination law, competition law, and any festival-specific rules that apply in their jurisdiction

GenFlix provides software infrastructure and does not become the promoter, operator, agent, partner, fiduciary, employer, sponsor, or co-organiser of a festival unless GenFlix expressly agrees in a separate written agreement.

Programme terms set by a Festival Organiser are between the organiser and each submitting creator. Those terms must not conflict with these Terms, misrepresent GenFlix, remove creator rights granted under applicable law, or require GenFlix to provide prizes, screenings, promotion, payment, or support that GenFlix has not agreed to in writing.

If a creator submits a work to a festival programme and that work is shortlisted, selected, awarded, or otherwise accepted for official exhibition, the creator authorises GenFlix to make the submitted work available to the authorised Festival Organiser and their approved team for festival operations. This may include secure streaming, technical review, judging, scheduling, event preparation, and downloading or saving an offline copy for the limited purpose of preparing and presenting the official festival screening or event.

Festival Organisers must protect any downloaded or offline copies, use them only for the relevant festival purpose, prevent unauthorised copying or distribution, and delete or securely archive them when they are no longer reasonably required for that festival purpose, unless a longer retention period is required by law or separately agreed with the creator.

Judges and co-organisers may access submissions, playback, notes, scorecards, rankings, and related metadata only for the festival purpose authorised by the organiser and GenFlix. They must keep non-public submissions and judging information confidential and must not copy, distribute, scrape, train models on, or commercially exploit submitted works or judging data outside the authorised Festival Studio workflow.

GenFlix may remove, hide, suspend, or refuse to publish any programme, category, invitation, submission, scorecard, or organiser account where GenFlix reasonably believes there is legal, safety, fraud, reputational, data protection, or platform-integrity risk.

1B. Agency Studio, briefs & creator matching

Agency Studio lets agencies, brands, production companies, labels, studios, publishers, and other approved users discover creators, create briefs, receive AI-assisted match suggestions, build shortlists, record notes, and contact creators about potential work.

Agency users are solely responsible for the briefs, requirements, project details, budgets, client instructions, products, trademarks, reference materials, and communications they submit or send through Agency Studio.

GenFlix may process agency briefs, profile information, shortlist activity, search filters, notes, and related workflow data to provide semantic search, creator recommendations, match scores, rationales, shortlist management, outreach, service quality, abuse prevention, analytics, and product improvement.

Agency Studio may use public creator profile data, public title data, GenFlix certification signals, embeddings, metadata, and platform intelligence to generate match suggestions. Match scores and rationales are decision-support tools only. They do not guarantee creator availability, suitability, performance, rights clearance, response, pricing, exclusivity, or commercial outcome.

Agencies must not use Agency Studio to scrape, bulk export, resell, train models on, benchmark, reverse engineer, or build competing datasets from creator profiles, creator works, match results, embeddings, rationales, shortlists, or other platform outputs.

Agencies must keep non-public briefs, creator contact details, shortlist notes, match rationales, and any private creator communications confidential and use them only for the relevant brief, evaluation, outreach, hiring, production, or collaboration purpose.

Any engagement, contract, payment, deliverable, rights clearance, employment relationship, agency relationship, production arrangement, usage licence, exclusivity term, tax obligation, or dispute between an agency and a creator is between those parties unless GenFlix expressly agrees otherwise in a separate written agreement.

GenFlix provides discovery and workflow infrastructure. GenFlix does not become the agency, employer, producer, representative, client, fiduciary, or guarantor of any agency, creator, brand, or production unless GenFlix expressly agrees in writing.

GenFlix may remove, hide, restrict, suspend, or refuse any brief, shortlist, outreach message, agency account, or match workflow where GenFlix reasonably believes there is legal, safety, fraud, confidentiality, intellectual property, reputational, data protection, creator protection, or platform-integrity risk.

2. Creator ownership of content

GenFlix does not claim ownership of your films.

Creators retain all copyright and intellectual property rights in any video, audio, text, imagery, or related material uploaded to the platform ("Creator Content").

By uploading Creator Content, you grant GenFlix a worldwide, non-exclusive, royalty-free, transferable licence to:

  • host
  • store
  • stream
  • display
  • encode
  • distribute
  • deliver through the platform

This licence includes the right to technically process and optimise the content for:

  • platform discovery
  • search indexing
  • recommendation systems
  • streaming infrastructure

This licence exists solely for the operation, development, distribution, and promotion of the GenFlix platform.

3. Content integrity

GenFlix does not edit, alter, remix, or modify creator films.

Films are presented exactly as uploaded by the creator.

The platform may perform technical processes necessary for secure hosting and playback including:

  • encoding
  • compression
  • format conversion
  • security processing
  • streaming delivery

These technical processes do not alter the creative substance of the film.

4. AI analysis, metadata & platform intelligence

To operate the platform, GenFlix processes Creator Content using internal and third-party technologies including artificial intelligence systems.

This analysis may generate signals and analytical outputs including:

  • GenFlix Certification Index (GCI) scores
  • metadata and tagging
  • prompt-consistency analysis
  • embeddings and feature vectors
  • technical diagnostics
  • discovery and recommendation metrics
  • audience engagement signals
  • behavioural analytics

These outputs collectively form part of the GenFlix platform intelligence layer.

Creators acknowledge that this analytical processing is a core component of the GenFlix platform and cannot be opted out of while using the Service.

GenFlix may use automated systems and machine learning tools to:

  • analyse content
  • classify films
  • generate embeddings and semantic vectors
  • power recommendation algorithms
  • improve discovery and platform intelligence

5. Ownership of platform signals & analytics

While creators retain ownership of their films, GenFlix owns all analytics, datasets, signals, and intelligence derived from platform activity ("GenFlix Outputs").

These outputs may include:

  • GenFlix Certification Index scores
  • metadata frameworks
  • prompt analysis
  • technical diagnostics
  • viewer engagement signals
  • heatmaps and retention curves
  • sentiment analysis
  • aggregated viewing patterns
  • audience discovery metrics

GenFlix may license, distribute, or otherwise commercialise GenFlix Outputs and aggregated audience datasets provided that such datasets are always anonymised and de-identified.

Under no circumstances will these datasets contain personally identifiable information or creator-identifiable information.

These datasets may be used for purposes including:

  • artificial intelligence research
  • machine learning model development
  • industry analytics
  • platform benchmarking
  • advertising intelligence
  • platform innovation

Where shared externally, all datasets will be:

  • anonymised
  • de-identified
  • aggregated
  • non-reconstructable to any specific creator or film

Such anonymised datasets may be shared with:

  • research institutions
  • artificial intelligence laboratories
  • technology partners
  • academic organisations
  • industry research groups

Creators acknowledge that they are not entitled to royalties or compensation arising from the commercialisation of these anonymised datasets.

These outputs do not represent ownership of the creator's film itself.

6. Signals vs pixels framework

GenFlix distinguishes between two categories of data.

Pixels refer to raw creator media including:

  • video files
  • audio tracks
  • imagery
  • film assets

GenFlix will not sell or license raw creator media to third parties for the purpose of training generative media models without explicit permission from the creator.

Signals refer to derived analytics including:

  • scoring systems
  • engagement metrics
  • behavioural signals
  • platform insights

GenFlix may aggregate, anonymise, and commercialise signals derived from platform activity for research, benchmarking, and industry intelligence.

7. Film deletion & data retention

Creators may remove their films from the platform at any time.

When a film is removed:

  • the film is removed from active systems
  • creator-identifiable metadata is removed
  • deletion propagates through infrastructure and backup systems within standard technical lifecycle processes

However, anonymised analytics derived from historical platform activity may be retained.

Examples include:

  • GCI scoring signals
  • engagement statistics
  • aggregated viewing metrics

These signals:

  • do not identify the creator
  • cannot reconstruct the original film
  • exist only as anonymised platform intelligence

Such signals may continue to contribute to aggregated datasets used for:

  • research
  • benchmarking
  • platform analytics

8. AI personas, likeness & biometric considerations

Creators may use AI-generated characters, voices, or personas within their films.

Creators represent and warrant that they have obtained all necessary rights and permissions for any:

  • likeness
  • voice replication
  • visual identity
  • character representation
  • brand or trademark reference

This includes compliance with:

  • copyright law
  • personality rights
  • publicity rights
  • trademark law
  • applicable biometric or likeness regulations

Creators acknowledge that synthetic media technologies such as voice synthesis, digital likeness generation, and AI personas may carry legal obligations under applicable laws.

GenFlix may introduce tools designed to identify potential conflicts involving synthetic personas, copyrighted characters, or likeness rights.

These tools operate on a best-effort basis only.

Creators remain solely responsible for ensuring that their content does not infringe the rights of any third party.

GenFlix is not liable for any claims arising from the use of AI-generated personas, voices, or likenesses within creator films.

9. Acceptable use & content standards

GenFlix is a curated platform and reserves the right to remove content that violates platform standards.

Prohibited content includes:

  • copyright infringement
  • non-consensual deepfakes
  • impersonation or misuse of a real person's identity
  • illegal activities
  • content promoting violence, terrorism, or criminal activity

Content may also be removed if it fails to meet the minimum technical standards required for the GenFlix Certification Index.

GenFlix may remove, restrict, or demote content that poses safety, legal, reputational, or platform integrity risks.

10. Platform automation & moderation

GenFlix may use automated moderation systems and artificial intelligence safety tools to monitor and enforce platform policies.

These systems may:

  • flag content
  • restrict distribution
  • demote visibility
  • remove content

GenFlix may also conduct manual reviews where necessary.

11. Future monetisation

GenFlix is currently a free platform.

GenFlix may introduce monetisation mechanisms including:

  • subscriptions
  • licensing programs
  • creator grants
  • revenue participation models
  • advertising
  • industry partnerships

Any creator revenue sharing will be governed by a separate Creator Monetisation Addendum.

12. The GenFlix Champion Grant

GenFlix may award financial grants to creators based on platform performance metrics.

The GenFlix Champion Grant may include awards such as:

  • AUD $1,000
  • other incentives determined by GenFlix

Receiving a grant does not create an employment or agency relationship.

Creators remain responsible for applicable taxes.

GenFlix may disqualify films where:

  • score manipulation occurs
  • copyright infringement is detected
  • platform rules are violated

13. Algorithm integrity & platform protection

The GenFlix Certification Index (GCI), recommendation systems, discovery algorithms, and platform analytics constitute proprietary technology and intellectual property owned by GenFlix.

Users and creators agree not to:

  • attempt to reverse engineer or infer the internal structure of scoring systems
  • manipulate platform algorithms or recommendation systems
  • artificially inflate engagement metrics or viewer activity
  • use automated systems or bots to influence rankings, scores, or discovery
  • attempt to extract or replicate platform intelligence systems

GenFlix reserves the right to investigate suspected manipulation and may take actions including:

  • removal of affected content
  • adjustment or nullification of platform metrics
  • suspension or termination of accounts

14. Indemnity

Creators agree to indemnify and hold harmless GenFlix from claims arising from:

  • creator content
  • violation of these Terms
  • copyright infringement
  • trademark infringement
  • misuse of likeness or identity
  • unlawful activity

Creators also agree to defend and indemnify GenFlix against claims related to:

  • AI-generated likenesses
  • voice replication
  • synthetic personas
  • unauthorised intellectual property use

15. Disclaimers & limitation of liability

The GenFlix service is provided on an "as is" and "as available" basis.

GenFlix does not guarantee:

  • uninterrupted service
  • security
  • error-free operation

The GenFlix Certification Index is an analytical tool and does not guarantee commercial success.

To the maximum extent permitted by law, GenFlix shall not be liable for indirect or consequential damages arising from the use of the platform.

Nothing in these Terms excludes rights under the Australian Consumer Law.

16. Governing law & dispute resolution

These Terms are governed by the laws of Queensland, Australia.

Users must first attempt to resolve disputes informally by contacting:

If unresolved, disputes fall under the jurisdiction of the courts located in Brisbane, Queensland.

Users agree to resolve disputes individually and waive participation in class action proceedings where permitted by law.

17. Changes to terms

GenFlix may update these Terms from time to time.

Where material changes occur, reasonable notice will be provided before the updated Terms take effect.

Continued use of the platform constitutes acceptance of the revised Terms.
